View Full Version : Deputy discovers car 'smoking' a bag of marijuana

Where there's smoke, there's fire, the saying goes. But sometimes, where there's smoke, there's marijuana shoved against a car's air intake.

A Burleigh County sheriff's deputy noticed a car on Interstate 94 with smoke rolling out of the hood at 5 p.m. Thursday, so he pulled the vehicle over to make sure everything was OK, Lt. Nick Sevart said.

The driver told the deputy he had been having problems with the car overheating. The deputy learned the man was driving under suspension, so he arrested him for offense, Sevart said.

Before the deputy searched the car as part of the arrest, he put the car hood up to make sure nothing was on fire. He noticed a bag shoved against the vehicle's air intake, Sevart said.

He said the bag contained 14 packages of marijuana, totalling 3 ounces of the drug. The bag's placement likely was causing the car to overheat, Sevart said.

Sevart said the driver told the deputy he was taking the car, which is not registered to him, on a test drive to Jamestown.

Johnny Lerma, 37 of Mandan, was charged Friday with possession of marijuana with intent to deliver, a Class B felony, and driving under suspension, a Class B misdemeanor.

South Central District Judge Gail Hagerty set bond for Lerma at $10,000 cash at the request of Burleigh County State's Attorney Richard Riha. Riha said Lerma has a lengthy criminal history out of Illinois and Minnesota, including convictions for several drug charges, robbery and battery
