Three Men Allegedly Attempted To Steal Pot
SACRAMENTO A Sacramento woman is being questioned after allegedly shooting a man in the head who was attempting to steal pot plants growing in the woman's backyard.
The shooting happened about 2:45am on Main Ave. and Taylor Street. Police say as many as three people allegedly tried to break into the backyard of a home where 12 marijuana plants were growing and steal them.
That's when a woman inside the home grabbed a rifle and fired hitting one of the alleged thieves in the head.
"If you are going to use any kind of deadly force you have to be in fear for your life," said Sacramento police Sgt. Leong told CBS13 News, "In fear of your property alone is not justification to shoot and use deadly force."
Police say they are getting conflicting accounts about the why the marijuana was being grown in the backyard.

is what one friend of mine does to deter rippers. I think if this woman was a crack shot, she would have hit him somewhere else, but maybe it happened too fast!

crazy,at what point are you allowed to fear for your life?when they got a gun to ya head?do you wait for that moment?do you go back inside and sit down and have a cuppa and ponder over it?
do same rules apply for cops as the public?eg,he reached into his pocket so i shot him etc...?
While the statutes defining the legitimate use of force in defense of a person vary from state to state, the general rule makes an important distinction between the use of physical force and deadly physical force. A person may use physical force to prevent imminent physical injury, however a person may not use deadly physical force unless that person is in reasonable fear of serious physical injury or death. Most statutes also include a duty to retreat (notable exceptions include Louisiana and Florida: see stand-your-ground law), wherein deadly physical force may only be used if the person acting in self defense is unable to safely retreat. A person is generally not obligated to retreat if in one's own home (for example, a person doesn't have to retreat from the living room to the kitchen, then to the bedroom, then to the bathroom) in what has come to be called the "castle exception" (derived from the expression "A man's home is his castle").

The defence of property is a possible justification used by defendants who argue that they should not be held liable for the loss and injury they have caused because they were acting to protect their property. Courts have generally ruled that the use of force may be acceptable, but that lethal force is generally not acceptable in defending property, although it may be acceptable in self-defense or, in some countries, the defense of one's home. As deadly force is not allowed, the setting of booby-traps and the use of dangerous guard dogs is also either not allowed or only allowed on strict terms such as the prominent display of warning notices.

Sounds to me that the law says she was supposed to go back to the "kitchen grab a cup and ponder it." :(
